Arbi­tra­tion Act, 1940 — Sec­tion 34 — Stay of suit — Arbi­tra­tion Act, 1940 — Sec­tion 34 — Stay of suit — In ear­lier round of lit­i­ga­tion appel­lant sought amend­ment of plaint mak­ing cat­e­gor­i­cal state­ment to delete names of defen­dants and con­tinue suit against those who were not par­ties to arbi­tra­tion agree­ment — If names of defen­dants are allowed to be deleted, arbi­tra­tion agree­ment can­not be invoked — Impugned order main­tain­ing stay of suit and dis­miss­ing appeal unsus­tain­able and set aside — Appeal allowed.
