Civil Pro­ce­dure Code, 1908 — Order 27, Rule 26 — Stay of exe­cu­tion — Civil Pro­ce­dure Code, 1908 — Order 27, Rule 26 — Stay of exe­cu­tion — Decree of evic­tion — Respon­dent seek­ing direc­tions to appel­lant to pay or deposit fixed amount of Rs. 1,80,000/- per month by way of mesne prof­its dur­ing hear­ing of appeal — Once exe­cu­tion of decree for evic­tion is stayed, appel­lant can be put on such rea­son­able terms to rea­son­ably com­pen­sate the decree-holder for loss occa­sioned by delay in exe­cu­tion of decree by grant of stay in the event appeal is dis­missed — Tak­ing over all view of mate­r­ial made avail­able by par­ties, appel­lant directed to pay mesne profits/compensation for use and occu­pa­tion of premises at the rate of Rs. 15/- per sq. feet sub­ject to final deter­mi­na­tion of same by a com­pe­tent forum.
