Con­sti­tu­tion of India — Arti­cle 226 and 32 — right to approach court for redres­sal of per­sonal griev­ances — depart­ment can put no fet­ters on right of cit­i­zen to approach court — No author­ity can find fault with a cit­i­zen of this coun­try for avail­ing a con­sti­tu­tional rem­edy — We find that the lan­guage of the arti­cle of charges is infe­lic­i­tous — There is no ques­tion of any per­son suc­ceed­ing in obtain­ing a stay — peti­tioner only approached the Court and the Court hav­ing regard to the facts and cir­cum­stances of the case granted the stay — that can­not be an act of insub­or­di­na­tion or mis­con­duct — peti­tioner only approached Court and Court hav­ing regard to facts and cir­cum­stances of case granted stay — impugned order quashed.
