Guardians and Wards Act, 1890 — Sec­tions 7 and 17 — Cus­tody of minor child — Guardians and Wards Act, 1890 — Sec­tions 7 and 17 — Cus­tody of minor child — Prin­ci­pal con­sid­er­a­tion for the Court to ascer­tain (i) whether the cus­tody of the child is law­ful or ille­gal and (ii) para­mount con­sid­er­a­tion is wel­fare of the child and not the legal right of either of the par­ties — Appellant?s con­tention that his wife was suf­fer­ing from men­tal ail­ment — Med­ical reports from USA reveal ?with no obvi­ous med­ical prob­lems? and of AIIMS of the year 2000 also do not show that wife was suf­fer­ing from any such seri­ous men­tal ail­ment — Appel­lant being an Advo­cate requires lot of time in legal pro­fes­sion — Wife liv­ing with her par­ents — Her father is well edu­cated, did Doc­tor­ate in Econo­met­rics from Man­ches­ter Uni­ver­sity, U.K. and joined World Bank, held very senior posi­tions, and is finan­cially sound per­son to look after the needs of his daugh­ter and grand-daughter — Child is also looked after by grand-mother — No ground to take con­trary view and dis­turb the present cus­tody of minor child and give to the appel­lant — Appeal dis­missed.
