Guardians and Wards Act, 1890 — Sections 7 and 17 — Custody of minor child — Guardians and Wards Act, 1890 — Sections 7 and 17 — Custody of minor child — Principal consideration for the Court to ascertain (i) whether the custody of the child is lawful or illegal and (ii) paramount consideration is welfare of the child and not the legal right of either of the parties — Appellant?s contention that his wife was suffering from mental ailment — Medical reports from USA reveal ?with no obvious medical problems? and of AIIMS of the year 2000 also do not show that wife was suffering from any such serious mental ailment — Appellant being an Advocate requires lot of time in legal profession — Wife living with her parents — Her father is well educated, did Doctorate in Econometrics from Manchester University, U.K. and joined World Bank, held very senior positions, and is financially sound person to look after the needs of his daughter and grand-daughter — Child is also looked after by grand-mother — No ground to take contrary view and disturb the present custody of minor child and give to the appellant — Appeal dismissed.
