No damages if sterilization ineffective

NEW DELHI: A cou­ple that chooses to give birth to a child con­ceived despite under­go­ing ster­il­iza­tion can­not demand money to raise it,National Con­sumer Dis­putes Redres­sal Com­mis­sion has ruled.


While decid­ing a case filed by a woman against St Stephen’s Hos­pi­tal, the con­sumer court said, “Ster­il­iza­tion is not 100% safe and secure” and a child con­ceivsed and born after an unsuc­cess­ful tubec­tomy can­not be termed unwanted. “Com­pen­sa­tion for main­te­nance and upbring­ing of such a child can­not be claimed,” it said.
