BIMLA DEVI Vs STATE OF HP 30.09.2010
RV RAVEENDRAN & JM PANCHAL, JJ.)
Civil Appeal No. 8428 of 2010 [Arising out of SLP © No.8030 of 2006].
Service Law — Appointment — Different Courses — (ii) One year National Trade Certificate in Dress Making and one year National Trade Certificate in Embroidery and Needle Work — respondents resisted petition on ground that fourth respondent was recommended for post by third respondent as it considered that National Trade Certificate in Cutting & Tailoring was equivalent to National Trade Certificate in Dress Making and that fourth respondent had other requisite qualifications — It was also contended that training in Cutting & Tailoring trade was virtually same as training in Dress Making trade — appellant has produced before this Court syllabus for Dress Making Trade course and syllabus for Cutting & Sewing Trade course — She has also produced minimum qualifications prescribed for admission to Cutting & Tailoring course and minimum qualifications for Dress Making Trade course — These show that both Dress Making course and Cutting & Sewing course are one year courses, but entry qualification for two courses are different — Further what is produced before us is syllabus for Cutting and Sewing trade course and not for Cutting & Tailoring trade course which has been considered to be equivalent to Dress making trade course — It is possible that having regard to job requirements, Selection Board proceeded on basis that National Trade Certificate in Cutting & Tailoring is equivalent to National Trade Certificate in Dress Making.
