Karnataka high court raps advocates for lending their name in PILs as litigants

Kar­nataka high court has dis­missed a PIL chal­leng­ing the allot­ment of 60 acres land to Goa Min­er­als Pvt Ltd at Belur Indus­trial Area, Dhar­ward for set­ting up a sponge iron and steel plant.


A divi­sion bench headed by chief jus­tice D H Waghela also came down heav­ily on the prac­tice of some advo­cates lend­ing their names as lit­i­gants in PILs.


In recent times, this Court is com­ing across sev­eral cases assail­ing pol­icy deci­sions, and actions of the exec­u­tives and var­i­ous author­i­ties wherein advo­cates as par­ties (lit­i­gants) attempts to espouse some assumed or alleged pub­lic inter­est where in fact, fil­ing of such peti­tions runs con­trary to pub­lic inter­est Mere lend­ing of names by advo­cates to such lit­i­ga­tions nei­ther in any way enhance pub­lic inter­est nor give cre­dence to their cause” the bench strongly observed while impos­ing a cost of Rs 40,000 upon peti­tion­ers Dharwad
