Release of Vehicle - Section 451 of Criminal Procedure Code

In an appli­ca­tion for spur­dari of vehi­cle, police gave report that vehi­cle should not be released because instal­ments of Finance Com­pa­nies are yet to be paid. The vehi­cle was impounded in a kid­nap­ping case. Can police do so ?

Answer:-

Police has no role to play with respect to finance of vehi­cle, when the point in issue is not same. Supreme Court has already issued direc­tions in this regard in “(2010) 6 Supreme Court Cases 768″ “Sun­derb­hai, (2002) 10 SCC 283 and Gen­eral Insur­ance Coun­cil, (2007) 12 SCC 354″
