In an application for spurdari of vehicle, police gave report that vehicle should not be released because instalments of Finance Companies are yet to be paid. The vehicle was impounded in a kidnapping case. Can police do so ?
Answer:-
Police has no role to play with respect to finance of vehicle, when the point in issue is not same. Supreme Court has already issued directions in this regard in “(2010) 6 Supreme Court Cases 768″ “Sunderbhai, (2002) 10 SCC 283 and General Insurance Council, (2007) 12 SCC 354″
