HOW TO EFFECTIVELY DEFEND IN DEPARTMENTAL/DOMESTIC INQUIRY [made easy]

Ensure the Procedure is followed by the Disciplinary Authority:

  1. When memorandum of charges is issued, ensure that it contains Article of Charges, List of Documents and List of Witnesses and the same are also supplied to you alongwith.  In case they are not supplied, make representation in writing to supply the same.

  1. Ensure that written statement of defence is exhaustive and giving complete defence you are going to take during the course of trial.  Take all the possible legal defences available to you.  Disciplinary authority can consider your written statement of defence and even close the inquiry, if he finds the same plausible.

  1. In case inquiry proceeds further, make sure that you get good defence assistant or a legal practitioner.  Make representation in writing in this regard.

  1. Ensure to inspect documents in original to find out any interpolation in documents.  Do not just depend upon photocopies supplied to you.

  1. Ensure that witnesses are effectively cross-examined.  In case you want to confront them with any documents or records, seek the copies thereof in advance from inquiry officer.

  1. In case you see any indication of biasness in Inquiry Officer, make representation immediately to the Disciplinary Authority.

  1. Ensure to get copies of statement of witnesses and daily order from the inquiry officer.

  1. Ensure that presenting officer is not a witness in the inquiry.
